Privacy policy

Last updated: September 30, 2026

This Privacy Policy explains how CognaCore, LLC (“CognaCore,” “we,” “us”) collects, uses and shares information when you visit www.cognacore.com (the “Site”) or contact us. The Site provides information about our consulting services, advisory and research work, and training, and lets you contact us.

Information We Collect

Information you give us. When you complete a form, email us or otherwise contact us, we collect what you provide. This may include your name, email address, phone number, employer, job title, industry and the content of your message. Our forms save what you type as you type it, before you press submit, including text you later change or delete. We use this to follow up on inquiries you started but did not send.

Information collected automatically. When you use the Site, we and our service providers automatically collect information about your device and your visit. This includes your IP address, approximate location derived from your IP address, browser and device type, operating system, referring website, pages viewed, time spent, links and buttons clicked, scrolling, and similar interactions. We collect this through cookies and similar technologies described below.

Information from third parties. Our visitor identification providers may tell us which organization a visit came from and, for some visitors in the United States, the name, job title and professional profile of the person they believe made the visit. This information comes from the providers’ own data, not from you.

How We Use Information

• To respond to inquiries and provide the services you request

• To understand how the Site is used, which content is useful, and where it can be improved

• To identify organizations that may be interested in our services and follow up with them

• To follow up with people who start a form but do not submit it

• To send updates about our services, where permitted, with an option to unsubscribe

• To maintain the security and proper operation of the Site

• To comply with legal obligations and enforce our terms

• To look up public business information about people and organizations that contact us or visit the Site, such as job title, company, company size and industry, from business data providers, so we can reply with the right person and the right material. We may use software, including AI tools, to draft our replies; a person reviews every message before it is sent

• If you visit our careers pages, to treat your visit and any application as recruiting interest and keep it separate from sales follow up

How We Share Information

We do not sell personal information for money. We share information only as described here:

• Service providers that help us run the Site and our business, including website hosting and forms, analytics, visitor identification, customer relationship management, internal messaging and cloud storage. They may use the information only to provide services to us, except where their own privacy policies allow additional uses of data collected through their tools, as described under Analytics partners below.

• Advertising platforms, for measurement and audiences as described under Advertising partners below, only when you allow marketing cookies.

• Legal and safety reasons, when we believe in good faith that disclosure is required by law or legal process, or is necessary to protect the rights, property or safety of CognaCore, our users or the public.

• Business transfers, if CognaCore is involved in a merger, acquisition or sale of assets, in which case information may transfer to the new owner under this Policy.

Cookies and Similar Technologies

We use cookies, tags, scripts, pixels and local storage to run the Site, understand how it is used and identify business interest. We group them as follows:

• Necessary: run the Site, remember your cookie choice and keep the Site secure.

• Analytics: measure visits, pages, clicks and conversions.

• Form drafts: save what you type into our forms before you submit, so we can follow up on unfinished inquiries. This runs only when analytics cookies are allowed.

• Session recording: show how visitors move through pages, so we can fix problems and improve content.

• Marketing and visitor identification: identify organizations and, in the United States, individuals visiting the Site for sales follow up.

Analytics partners. We use Google Analytics to measure how the Site is used. We do not send names, email addresses or phone numbers to Google Analytics. We use Google signals, so for visitors signed in to a Google account with ad personalization turned on, Google may link visits across devices and we see demographics and interests in aggregate. You can manage this in your Google account settings or opt out at tools.google.com/dlpage/gaoptout. We also partner with Microsoft Clarity to capture how you use and interact with the Site through behavioral metrics, heatmaps and session replay, to improve and market our services. Text you type into forms is masked in these recordings. For more on how Microsoft collects and uses data, see the Microsoft Privacy Statement at privacy.microsoft.com.

Visitor identification. Our providers may match your visit to an organization using their own business data, so we can tell which organizations are interested in our services. For visitors in the United States: when you visit or log in to our website, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email. We (or service providers on our behalf) may then send communications and marketing to these email addresses. You can opt out at app.retention.com/optout, reject marketing cookies using Cookie Settings, or email us to ask that your details be excluded from our records. These providers may also use information collected through their tools for their own purposes as described in their privacy policies.

Advertising partners. When you allow marketing cookies, advertising platforms we use (search, social and AI assistant advertising services) may set cookies or pixels on the Site to measure whether our ads led to a visit or an inquiry and to show our ads to people who have visited the Site. These platforms may combine this with information they already hold about you under their own privacy policies. We do not sell your information; some laws treat this kind of sharing for advertising as a "sale" or "sharing", and you can opt out at any time by rejecting marketing cookies in Cookie Settings, through the industry opt out at optout.aboutads.info, or by emailing us. Advertising cookies do not run for visitors who reject marketing cookies, and never on our careers or legal pages.

Your Choices

Cookie Settings. The first time you visit, the Site shows a cookie banner. You can change your choice at any time using the Cookie Settings link at the bottom of every page.

• European Economic Area, United Kingdom and Switzerland: only necessary cookies are used until you choose to accept others.

• All other locations: analytics, session recording and marketing cookies are used when you arrive, and you can reject them at any time through the banner or Cookie Settings.

Browser controls. Most browsers let you block or delete cookies. Blocking necessary cookies may stop parts of the Site from working.

Other opt outs. You can opt out of Google Analytics with Google’s browser add on at tools.google.com/dlpage/gaoptout.

Do Not Track. Some browsers send a Do Not Track signal. Because there is no common industry standard for responding to these signals, the Site does not respond to them at this time.

How Long We Keep Information

• Site analytics data: 14 months, with a copy kept in our own reporting storage.

• Session recordings: 30 days. Recordings and heatmaps we save for review: up to 9 months.

• Visitor identification data: as long as the organization or contact remains relevant to our business, and deleted on request.

• Form submissions and correspondence: as long as needed to respond and manage our business relationship, then deleted or anonymized.

• Form entries saved before you submit: 90 days, unless you send the form or we follow up with you, in which case they are kept with that inquiry.

• Advertising audiences: up to 180 days from your last visit.

Security

The Site uses HTTPS encryption, and we limit access to personal information to people who need it for their work. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your Privacy Rights

Depending on where you live, you may have the right to:

• Know what personal information we hold about you and get a copy

• Correct inaccurate information

• Delete your information

• Opt out of targeted advertising, and of any “sale” or “sharing” of personal information as those terms are defined in some state laws

• Appeal if we decline your request

To make a request, email legal@cognacore.com with “Privacy Request” in the subject. We will verify your request using the information you provide and respond within the time required by applicable law. You may use an authorized agent where the law allows. We will not treat you differently for exercising your rights.

We may keep some information where we need it to complete a transaction, detect security incidents, comply with a legal obligation, or for other purposes permitted by law.

Visitors in the European Economic Area, United Kingdom and Switzerland

Legal bases. We use analytics, session recording and marketing cookies, and save form entries before you submit, only with your consent, which you can withdraw at any time through Cookie Settings. We process information you send us to respond to your request, and for our legitimate interests in running and securing the Site and our business.

International transfers. CognaCore is based in the United States, and our service providers may process information in the United States and other countries. Where required, transfers rely on safeguards such as the EU Standard Contractual Clauses or the EU US Data Privacy Framework, as offered by our providers.

Your rights. You may request access, correction, deletion, restriction or portability of your personal information, and object to processing based on legitimate interests. You may also complain to your local data protection authority.

Children

The Site is intended for business users and is not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information, contact us and we will delete it.

Email Communications

If you receive email from us, you can unsubscribe at any time using the link in the email. We may receive a notification when you open an email or click a link in it, to understand which communications are useful.

Links to Other Sites

The Site links to other websites. We are not responsible for their content or privacy practices, and encourage you to read their privacy policies.

Changes to this Policy

We may update this Policy from time to time. We will post the updated version on this page with a new “Last updated” date, and where changes are significant we will provide a more prominent notice.

Indemnification

You agree to indemnify, defend and hold harmless CognaCore, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. CognaCore reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with CognaCore in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and CognaCore agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

COGNACORE, LLC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COGNACORE, LLC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF COGNACORE, LLC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction

CognaCore reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington and you hereby consent to the exclusive jurisdiction and venue of courts in Washington in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and CognaCore as a result of this agreement or use of the Site. CognaCore's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of CognaCore's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by CognaCore with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and CognaCore with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and CognaCore with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
